New Gearbox!

Hi,

This post follows on from this one:

but as the nature of my problem has changed I wanted to post again to get peoples thoughts.

The brief synopsis is that I bought a D3 HSE 98,000 on the clock over the phone / internet about 10 days ago. The car has a problem with the revs surging and after some consultation with the garage where I bought it from (Some 250 miles away from where I live) they told me to take it to a Land Rover specialist. So I took it to Guy Salmon in Portsmouth. Guy Salmon have looked at the issue and have declared that a gear is slipping and that it will require a new gearbox.

The car did come with a 3 month warranty, but I have since found out that this is the garages own warranty and I only have my email to them confirming the deal, nothing from them confirming it.

Guy Salmon are estimating £3000 to fit a near gear box.

I am waiting to hear from the garage where I bought it from as to what they intend to do about it, but I thought I'd post on here in the hope that someone might be able to shed some light on my rights etc.

edited: This post is about the best fix - not about the warranty or no warranty issue.

Sorry, I don't buy this "needs a new gearbox" [@3k Shocked] diagnosis!!!!

A gear is slipping, so whatever happened to replacing the faulty parts?
You do not need a complete new gearbox to do that!

I'd take your D3 to a decent independant LR specialist.
Have them remove the gearbox and have a specialist Transmission company repair it!
The Transmission company may even be able to remove it themselves.
That's got to be much cheaper than renewing the complete gearbox!
But before doing so, investigate the fix with the above first.

I'd kick of by trying JE engineering in Coventry.

Did you pay they deposit or any of it on credit card? That'll give you a lot more clout to get your money back. Je is a good place to start if you want it repaired.

Try Honest John of the Daily Telegraph. He knows exactly what your rights are and will use his Saturday column to embarrass poor providers / dealers, and has had many successes supporting purchasers.

If it was a private sale, I understand you have not much to stand on; with a dealer (even a hobbyist who dabbles) - you should have no problem (but that's MY view and HJ really knows his stuff).

As far as I know the reason garages give a 3 month warranty is that they have no choice and it is a legal requirement when buying from a trader. Not sure I agree with a replacement auto gearbox, personally I would take it to a auto specialist and let them diagnose the problem.

You are not far from me by the sounds of it, so you are welcome to come by and have a go in mine if you want to compare it.

Dont fancy stripping an Autobox myself... Whistle

But yes, a minimum of 3 month warranty must be given with a car, unless otherwise stated (Sold as seen etc) There is usually a maximum limit per claim too. If they wont cover the full cost of repair, hand the car back and/or get trading standards involved Thumbs Up

Thanks for all the info so far guys. The main dealer have suggested a replacement gear box as the cost for them to repair the gear box (and probably the skill required) makes it cheaper to replace rather than fix, but they did suggest it could go to a specialist to be repaired.

I am waiting for a call back from the garage where I bought the car from, so hopefully they'll just get it sorted. I would just like to know where I stand legally before I talk to them.

So far the car had a new turbo before I even took delivery, the rear brake has broken up and I need a new gear box / repair. I am wondering if I've bought a lemon.

I'll let you know more when I've spoken to the garage that sold it.

If you bought this ten days ago and paid a fair price for it (not trade), then you should not pay a penny to have this fixed. Ring trading standards who will tell you your rights and what to do. You may even be able to reject it.

The car should be expected to work for a period of time longer than 10 days after you bought it!

thanks for the advice. I am going to see what the garage says on monday to see what they want to do, before I start to take action. They might be excellent and agree to sort it all out or swap the car for another etc. So I'll see what they say and then go from there. I'll keep you all informed of my progress though.
