Excellent post! IMHO see the whites of their eyes, much much harder to fob you off. You are a much bigger fish and potentially more damaging to a dealer than to LR. Evil or Very Mad

wow I am so glad that my dealer was very easy to deal with and bent over backwards to help, I rejected my vehicle and am awaiting the new one which is to be delivered in October. I just walked into my dealers and told them I was not happy and gave them a week to sort something out, this they did which involved a CS manager from the factory visiting the vehicle and accepting that I was right to reject all over and done with in 6 weeks new one ordered.

Off to the dealer now - due in 4.pm - and am armed (NB not literally... though tempting) Twisted Evil with everything I think I need. I beleive all your experiences give me some idea of how to play things and is excellent advice.

You guys really do know your stuff and it will all be used - Ecosse - that narrative is worthy of a place on this forum as a handy tip for reference. I appreciate the disclaimer but as guidance of what its all about - its has to be a good starting point.

Hopefully I'll get some resoultion.

Having previously reached the stage of submitting my rejection letter to the dealer, I was given several options. One of these was replacement, with a contribution from me for the mileage I have put on the vehicle. (£1.5k for 10k miles)

Does anyone have any opinions or know the legal position here?

My chosen option was to accept replacement of the compressor, with an undertaking to replace the vehicle should this fail to cure the suspension problems. One week later, the problems are recurring....
 Long succession of Disco's since 2001...
SIII Lightweight - neglected & rusting. Bulkhead, A panels, vent panel & outriggers now disintegrated - Next years project!

£1,500 for the first 10,000 miles is not too bad at all in my opinion.

I had the choice of ex-demo 6mth /9,000 miler at £1,500 below best 'new' price. Went for new in the end.

If the problem recurs then you've got the perfect legitimate 'swap' option. Only problem would be the wait for replacement vehicle though.

Legally the dealer can knock off the depreciation and the miles. It is how hard you push and when to stop is the skill.

This may not actually always be the case - depending how quickly the rejection takes place & the circumstances surrounding it, if it successful then your entitlement would be restitution ie full refund. In practice (as BN says) however most rejections are dealt with by agreement rather than by recourse to law and as such a reasonable & practical approach of deducting a use allowance is taken.
