Rejection process How long did it take?

Hi all,
As some of you are aware I have had a few problems with my early D3 which I finally decided warranted replacement / rejection some weeks ago now.

So I approached my dealer principle and he has put all the necessary paperwork throught to LR, but I have lost count of the number of phone calls I have made to him, as he seems to be getting nothing from LR or that's the story I'm getting.

I just wondered if you guys who I know have had cars replaced could give me an idea of how long the process took, and what offers/ paperwork came from where with regard to your swaps.

Did you have to badger LRCS aswell??

Hi MVS,

I told my dealer that I wished to reject my vehicle in early September, however at that time they said that they would not accept this until they had monitored it for a couple more weeks. At the same time I had also involved LRCS. In mid September I had yet another compressor fitted which failed within 5 miles of picking the car up. I went back to my dealers (who I might add were very helpful and understanding) and they said they would contact LR about rejecting the vehicle. A week later I was asked to choose the colour and spec of the replacement vehicle. So it took me about 3 1/2 weeks to reject it in the end. I didnt pick the new car up until early October in the end because of poor health, but I am really pleased with the 2006 model HSE.

I never wrote a letter to reject the vehicle, I just told my salesman and then all the paperwork was handled by them.

Even though my old Discovery 3 had its problems it did not put me of having another one as it is a brilliant vehicle.

Rejections can be both quick or long winded. If the dealer has to up his quota of sales for the month and your rejection falls in that month it could be quick as they will take a chance and put it through on their own head be it touch. They still get their money eventually from LR, but they cover the risk.

If they don't then they deal with LR under the normal snail progress.

The best way is if the car is underivable and you are using a dealer loan car, they need to do something quickly then as well.

There are few rules in a rejection because technically the dealer has to also legally prove to LR the vehicle is sub standard as we would returning say a mobile phone that does not work correctly.

I see, mmm.

My dealer principle is being extremely helpfull, just seems to be taking an age.

I origionally approached him after my second compressor went, although it ended up being software/ wiring. Which they sorted, and I was happy to keep the car. But now the car has started throwing up errors again. Suspension, amongst them again, which they believe is a battery voltage issue as clears on a reboot.

Trouble is I only seem to get about 3-4 weeks relief then something else happens,and back she goes.

I have only dealt with dealer verbally as they are friendly/helpful. Should I resort to letters & calling LRCS.?

When dealing with rejections or anything like it, itemise your concerns and the defects of the vehicle.

I submitted a report of the 20 visits to the dealer and the 29 defects and errors that are still evident. List the time it has been in the dealers workshop and the items repaired, replaced and sorted. List how many software updates it has had and resets.

I then costed the trips to and from the dealers and the days lost in doing the trips and the cost to me per day lost. I then list the days lost without the use of the vehicle for which I paid a great amount of cash. In my case I need a vehicle to be able to tow at a moments notice, so if they loan me a car it is useless and then I bill them with the rental of a specialist or specialist vehicle, list that as well.

Just record everything and ensure that all the EPQRs are listed, because this helps a tremendous amount. No EPQR's and it is difficult to prove anything.

Keep the copy of the letter of course.

As far as dealing with LRCS goes, they will not speak to you at this stage because it is against their interest. However, if you have a LRCS you have dealt with over the time your car is having problems, put that persons name down and cross reference it.

Don't forget they will want to deduct the mileage (wear and tear) from you as well at so much per mile. It is important that you tell them in the letter the mileage that you became totally convinced that the car was no good to you. Any mileage after that is their problem.

It is sometimes useful to keep the lost hours that you have travelling to and from the dealers or waiting for the LRA as a backup to off set the wear and tear. For instance £500 per day over say 6 lost working days, is a lot of mileage compensation.

Finally do not be put off by the nice dealer, he is in business and it is your money at stake. There is no such thing as nice in this situation only factual business.

If your D3 is on finance the finance company may be the one that you have the contract with.
A few years ago I rejected a van that had bodywork repairs done before I got it.
Dealer washed their hands of it as they said my contract was with the Finance company.
Obviously try and keep life as simple as poss just keep going with the dealer if you can.
Took me 6 months but got a new one in the end.

As BN says, that is different, but the dealer is only washing his hands pm his contractual obligations to you directly. The finance company, usually as a result of their relationship with dealer networks (often by dint of a financial stake Wink ), often has more weight to throw about when it comes to dealing with a rejection..........

I do not know what the specific circumstances are in this particular case.

The big hurdle for me was the Dealer. As good and as helpful as they were in trying to rectify the problems, they initially refused to accept my vehicle as rejected.

They pretty much backed themsleves into a corner when they declared after my fourth compressor, that they had "fixed it completely and if it broke again they would take up my case."

It did break, I kicked off and 1 hour later a new identical replacement vehicle had been found (through the network or off the line?) and all I had to do was insure it. Arrived five days later - only delay was the time it took to fit A-fram, lamps and other accessories.

The dealer will try to fob you off, but as stated in this thread by many, ultimately the dealer has the power and it is they that should start the ball rolling - I think this is true even with finance involved.

my experience was similar to woody in that i had 2 extended workshop visits for immobiliser issues, where they loaned me a demonstrtor, which then bcame extended issues regarding looms and alarms...i just told them i was rejecting it and 1 e mail to teh dealer principal later (with me still driving the MD's RR Vogue) a replacement option was offerd and delivered within 10 days.

Don't forget to place your loss of earnings into that equation when the final figure comes out. They could be more than the miles.

I would also add embarrassment (I was sick of telling people it was in the dealers), emotional distress (you never quite knew when it was going to bite you), and inconvenience. – All hard to quantify in monetary terms but certainly, worth more than 8K miles.

If you throw it on the table at the same time as you’re negotiating mileage adjustment payments, it strengthens your hand.

Contribute!!! Evil or Very Mad no way, i did not even enter in to a conversatioin regarding contribution, after all, would you expect to suffer depreciation for faulty white goods if they were not fit for purpoose, i dont think so. This makes my blood boil. I would agreee with the others that all the emotional and cost related issues probably mean that they owe you money so take no bull:censored: and ignore their silly demands. its a straight swap and they should be lucky to continue with us customers with ongoing service arrangements and accessory purchases to keep them warm through the cold winter nights.
