Not sure of the story but was it within warranty?
There is good reason to service with a dealer as they will help with out of warranty problems.

When it occurred it was just out of warranty - took it to the stealers twice after that and funny they had NOTHING to say at the time about changing of the pads then.
The brakes were serviced by a qualified licensed mechanic with extensive LR experience. LRA just looking for a half ass excuse to deny liability.
Blame somebody else for a well known and commonly complained about Park Brake failure across the entire world? If I didn't know better I'd say you work for Land Rover (no offense) - thanks for the heads up.

Now here's an analogy!
After extensive online research (if you can call it that) I can say this!
If the car is under warranty, Land Rover will fix the faulty park brake.
If the car is not under warranty, they will find a half ass lame excuse and blame you for it! Full stop!

OK I have more of a picture.
Under consumer legislation you have a statutary? right to recourse if there is a 'reasonable expectation' that the failed part should have lasted more than three years.
Problem is LR are saying it broke because it was not serviced or serviced incorrectly, what evidence do they have of this? If you had it serviced by a licensed mechanic he would have done the service according to Lr shedule and should have checked and adjusted the hand brake as part of those services.

I never got it fixed. Its still in the car in its original state for the past 3 years - never use it because of the problem and continue to argue with LRA to acknowledge the problem.
Lodged complaints with Fair Trading, NRMA and to Govt bodies to investigate and issue a safety recall on these but they fail to act. Gone down the road of "fit for purpose" and statutory obligations of the supplier etc etc. My lawyer tells me that its now a case of a civil claim against them.
I will go out of my way to make people aware of Land Rover's ethics. Very soon I will sell the D3 and despite it being a great car in many ways, I will NEVER buy Land Rover again and make a point of letting family and friends know the same.
Finally let me say this Caver, this is 1 of 1000 problems that I can write about! For certain reasons I cant say more but rest assured my statements are warranted and if you own a D3 or 4 sell it!

The info on that honest john link is incorrect. Its unlikely to be moisture causing the issue, and the system does not use pads! A good clean, lubrication and adjustment usually sorts it out. There many many threads and 'how to' information on this forum. Club 18 - 30 (I wish !!)

I'm certainly no mechanic and wouldn't attempt to repair the park brake myself or put it in the hands of a regular technician.
Land Rover looked at my EPB on 2 occasions and NEVER did they say it was a result of maintenance or lack thereof. I was told specifically that the EPB / Module / Unit or whatever you want to call it had to be replaced. Hence the reason I am pretty at the moment with them!
What they failed to state in the letter was that just prior warranty expiring it was taken to them for repairs under warranty. They actually carried out warranty repairs in 2009 but unfortunate for me was the EPB didnt fail at that time!

My attitude to a business has always been not whether something goes wrong but what they do when it does. I would be pretty off with LR in your situation. But my experience has been good with LR, when something failed the dealer replaced under warranty no issue. I think usually LR are good about claims under warranty, try making a claim against Ford or Holden.
Not so in your case.
What did Fair Trading say?
Incidentally only had a screamer once on one occasion and was fixed with an adjustment.
