Fees - Yes but I'll get all if not most back at court - especially as I have made significant moves to avoid litigation.
They recovered it after it broke down. Haven't driven or touched it since
Age and Mileage - Of course that's accepted

The most respected people for an appraisal of a motor vehicle would be someone like the RAC.
You can get an appraisal carried out that would indicate whether the vehicle was fit for purpose and they are very thorough.
Most important is that the appraisal would carry a little weight - plucking someone from a user forum is going to get you about as far as your ailing car.

Thanks for the RAC tip. The problem being is that the expert will need to write the report under Part 35 of the Civil Procedure Rules (his overriding duty is to the court and he has to state as such in the report)
Not sure if the RAC reports will do that. Will check it out.
I have an expert checking the docs and video at the moment. He is a vehicle expert and his reports work within the CPR.

Found an expert and the report will assist me in my claim. Now about to issue proceedings in the county court.

If I read this the way you meant it - you spend over £41k on a vehicle and have this many issues and just roll over and let them tell you it's satisfactory vehicle.

Look, I dont usually give advice, but here is mine.............................................................
In April 2007 I spent 38k on mine, chuffed to nuts with the purchase, but within weeks I found faults. Turbo went, EGR failed, EPB packed up, Wheel Sensor failed, EPB broke again, Fuse box shorted, Servo packed up etc etc etc.
Now yes I had a valid point to be a tad offish with my dealer, I was'nt happy...............But if you go against them instead of being with them they will fight you, and you WILL loose. You are a customer yes, and deserve a roadworthy vehicle, but to fight a brand the way you are will only end in tears TBH, and the legal costs against you if you lost will cost you what you hold dear to you.
The best you can hope for is that LR themselves take the car in to investigate your undisclosed issues, but you WILL still end up with the D3 you purchased, fixed or not. It just aint worth fighting your dealer, you need them more than they need you.
I tried going your route, but didnt want to risk legal as I value my home. SO good luck, and if you wanna carry on trying to take a Multi-national, government supported worldwide manufacturer, then start practising one phrase..........................................

Legally, this is the achilles heel in this case. As far as I can tell, the dealer has made efforts to resolve, or class as normal, all the issues. Fortunately, the UK legal system does not operate in the shadow of the US system...........
